Yes. In Texas, if you are paying child support for more than one child, the amount of child support will normally reduce when the oldest child turns 18 years old or graduates from high school – whichever occurs later. The Texas Family Code refers to this reduction in child support as a step down provision.

For instance, if the paying parent has two children, he or she is likely paying 25% of his or her monthly net resources as child support for both children. Upon the oldest child turning 18 or graduating high school (whichever is later), the paying parent’s monthly child support payment will “step down” to 20% of his or her monthly net resources, in accordance with the child support guidelines. A step down in child support payments may occur upon the earliest occurrence of one of the following events:

  1. any child reaches the age of eighteen years or graduates from high school, whichever occurs later;
  2. any child marries;
  3. any child dies;
  4. the child enlists in the armed forces of the United States and begins active service as defined by section 101 of title 10 of the United States Code; or
  5. any child’s disabilities are removed; or
  6. any child becomes legally emancipated.
